Terms and Conditions

Welcome to Landscape Launchpad LLC (“we,” “our,” or “us”). By signing up for our subscription-based web design service, you (“Customer” or “you”) agree to the following terms and conditions. Please read this agreement carefully.

 

1. Services Provided

Website Subscription Service

• • Your subscription includes:
    • A semi-custom, templated website design.
    • Pre-written content tailored to your business services.
    • Website hosting, maintenance, security, and SSL certification.
    • Unlimited content changes limited to text, photos, and service pages.
    • Regular updates and technical support.

Website Launch

• • We will endeavor to complete and launch your website in a timely manner. However, the timeline may depend on the responsiveness of the customer and the timely provision of required materials.
  • Once the website is created, the customer has 14 days to provide feedback. If no correspondence is received within this period, the work will be assumed approved and the website will be made live.

Domain Name

• • Customers are responsible for purchasing and maintaining their own domain name.
  • You must provide us with access to your domain’s DNS settings to enable website launch and functionality.

Content Changes

• • Unlimited content changes are limited to modifications in text, photos, and service pages.
  • Changes to the design, layout, or structural components of the website are not included in the subscription and will be quoted separately.

2. Ownership Terms

Customer Content

• • You retain full ownership of any documents, files, or information provided to us for the website.

Website Ownership

• • Ownership of the website will transfer to you after 24 successful monthly payments.
  • Until the ownership transfer is completed, the website remains the property of Landscape Launchpad LLC.

  • The website must remain hosted on our servers until 24 successful payments are completed and the plan is considered paid in full. After this period, there is no physical transfer of ownership; the customer is free to manage the website as they choose and may request the actual website files if they decide to discontinue our service.

Access Restrictions

• • Customers will not receive server-side or admin access until ownership is transferred or the subscription is paid in full.
  • Limited access for third-party marketing providers or managerial roles will be considered on a case-by-case basis. Customers must contact support to request such access.

3. Payments and Fees

Subscription Payments

• • Monthly subscription fee: $99.
  • Payments will be automatically charged to the credit card on file each month on the agreement start date.
  • After the 24-month period, monthly payments will continue for ongoing maintenance, hosting, and support unless canceled by the customer.

Declined Payments and Past Due Accounts

• • We will attempt to collect payment three times if a charge is declined.
  • Accounts 1 month past due will have their website frozen (taken offline) until the account is paid up to date and in good standing. The website will not be put back online if any past payments remain due.
  • Accounts 3 months past due will be in default, and the outstanding balance for the 24-month term will be due immediately in order to make the website live again.

Cancellation Policy

• • This subscription has no long-term contracts or commitments, and you are free to cancel at any time.
  • If canceled before 24 successful payments, the website and associated files remain the property of Landscape Launchpad LLC and will be deleted.
  • Customers may choose to pay the balance of the 24-month term in full at any time to retain ownership of the website and request the website files.

Additional Services

• • Any services outside the scope of this agreement, including design changes or structural modifications, will require a separate agreement and fee.
  • Our marketing services are billed separately and have no effect on this subscription or the ownership transfer timeline.

4. Guarantees and Disclaimers

Performance

• • We do not guarantee specific performance or results from your website. Success depends on additional marketing efforts outside the scope of our services.

Liability

• • Landscape Launchpad LLC will not be held responsible for issues such as unscheduled downtime, incorrect information, missing emails, or other problems beyond our control.
  • We are not responsible for any lost revenue related to website performance, downtime, or any other circumstances.

Third-Party Software and Content

• • Upon request, we will evaluate the suitability of third-party software, plugins, or integrations. Any software determined to be harmful, incompatible, or otherwise unsuitable will not be permitted on your website.
  • Website content must not be detrimental, inappropriate, or violate any laws. Content deemed harmful, offensive, or in violation of these terms will not be allowed.

5. General Terms

Credit and Portfolio Use

• • We reserve the right to place a credit link on the footer of each page of your website.
  • We retain complete permission to showcase your website in our portfolio, marketing materials, and promotional efforts.

Entire Agreement

• • This document represents the entire agreement between you and Landscape Launchpad LLC.

Severability

• • If any provision of this agreement is deemed unenforceable, the remaining terms remain in full effect.

Governing Law

• • This agreement is governed by the laws of the State of New Jersey.

Amendments

• • We may update these terms and conditions at any time. Changes will be communicated to you, and continued use of our services constitutes acceptance of the updated terms.
